به گزارش اثبات نیوز ، با روی کار آمدن دولت نهم یکی از چالشهای اصلی در صنعت نفت بحث عدم دریافت مطالبات کارگران شرکتهای پیمانکاری بود. در این بین با توجه فضای احساسی ایجاد شده در آن دوران، با دستور شخص رئیس جمهور، وزارت نفت در راستای حل مشکل کارگران شرکتهای پیمانکاری موظف به استخدام آنها شد تا حقوق این افراد به صورت مستقیم توسط وزارت نفت پرداخت شود. در این راستا حدود ۳۴ هزار نفر از نیروهای پیمانکاری توسط وزارت نفت به صورت قرارداد موقت مستقیم استخدام شدند و این شیوه از قرارداد در این دوره ابداع شد.
بدین صورت یک انشعاب دیگر به نیروهای شاغل در وزارت نفت افزوده شد و علاوه بر نیروهای رسمی و نیروهای پیمانکاری، دستهای از کارکنان وزارت نفت در قالب نیروهای قرارداد موقت مشغول به کار شدند.
نیروهای رسمی وزارت نفت که کارمند دولت بوده و دارای پست سازمانی هستند و طبق قانون وظایف و اختیارات وزارت نفت حقوق و مزایای آنها تعیین میشود. نیروهای پیمانکاری نیز با پیمانکار وارد قرارداد شده و طبق قانون کار حقوق خود را دریافت میکنند.
در این بین شرایط قراردادی نیروهای قرارداد موقت نیز ادغامی از شرایط دو نوع قبلی است. یعنی نیروهای قرارداد مدت موقت مانند نیروهای پیمانکاری قراردادشان یکساله با وزارت نفت منعقد شده و ذیل قانون کار تعریف میشوند، اما حقوق خود را مستقیما از وزارت نفت میگیرند و در بخشهای مختلفی در این وزارتخانه مشغول کار هستند.
اما شرایط عجیب و غریب نیروهای قرارداد موقت به همین وضعیت ختم نشد و در ادامه کار به دلیل انجام اصلاحات ناقص وضعیت این کارکنان در بلاتکلیفی بیشتری قرار گرفت، به گونهای که آنها برای احقاق حقوق خود بین قانون کار و قانون وزارت نفت در حال پاسکاری هستند.
کارکنان قرارداد موقت وزارت نفت چه مطالباتی دارند؟
در این راستا امروز (سه شنبه ۴ خرداد) جمعی از کارکنان قرارداد موقت وزارت نفت در مقابل مجلس شورای اسلامی تجمع کرده و خواستار پیگیری مطالبات خود توسط نمایندگان خانه ملت شدند. سخنگوی کارکنان قراردادی وزارت نفت در گفتگو با خبرنگار اقتصادی خبرگزاری فارس با اشاره به وضعیت بلاتکلیف کارکنان قرارداد موقت گفت: «بر اساس تصویب نامه هیئت دولت به شماره ۴۷۶۴۳۲۱۲۴۷۱ مورخ ۹۰/۱۱/۰۱ باید ۳۴ هزار کارمند قرارداد مدت موقت وزارت نفت تبدیل وضعیت میشدند».
وی ادامه داد: «مطابق بند ۶ تبصره هیئت دولت (تصویر ۱) که هر ساله شماره مصوبه آن در ابتدای قرارداد ما (تصویر ۲) ذکر میشود، شرکتهای تابعه وزارت نفت باید با کارکنان خود، قرارداد مدت معین منعقد نمایند. اما متاسفانه مدیران وزارت نفت مطابق بند ۱ تبصره هیئت دولت با حدود ۳۴ هزار نفر از کارمندان خود، قرارداد مدت موقت منعقد میکنند».
